By accessing and using Marsa ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms apply to all users, including buyers, sellers, and visitors.

2. Description of Service

Marsa is a B2B marketplace platform that connects buyers and sellers in Saudi Arabia. We provide tools for product listing, request for quotations (RFQ), messaging, and secure transactions between verified business parties.

3. User Accounts

To access certain features, you must create an account. You agree to:

Provide accurate and complete registration information
Maintain the security of your account credentials
Notify us immediately of any unauthorized access
Be responsible for all activities under your account

4. Seller Obligations

Sellers on Marsa agree to:

Provide accurate product descriptions and pricing
Maintain valid commercial registration in Saudi Arabia
Respond to buyer inquiries within 48 hours
Honor quoted prices and delivery terms
Comply with all applicable Saudi Arabian laws and regulations

5. Buyer Obligations

Buyers on Marsa agree to:

Submit RFQs in good faith with genuine purchasing intent
Provide accurate business information
Respect seller response times and pricing
Complete transactions as agreed with sellers

6. Prohibited Activities

Users may not:

Post false, misleading, or fraudulent content
Violate any laws or regulations
Infringe on intellectual property rights
Engage in spam or unsolicited communications
Attempt to circumvent platform fees
Use the platform for illegal goods or services

7. Personal Data Protection

Marsa processes your personal data in strict compliance with the Saudi Personal Data Protection Law (PDPL), Royal Decree No. M/19 dated 9/2/1443H. By using the Platform, you acknowledge and agree that:

Your personal data will be collected and processed as described in our Privacy Policy
You have the right to access, correct, and request deletion of your personal data
You may withdraw consent for data processing at any time (subject to legal retention requirements)
We implement appropriate technical and organizational measures to protect your data
Your data will not be transferred outside KSA except in compliance with Article 29 of the PDPL

8. Limitation of Liability

Marsa acts as an intermediary platform and is not a party to transactions between buyers and sellers. We are not liable for the quality, safety, or legality of items listed, the accuracy of listings, the ability of sellers to sell, or the ability of buyers to pay.

9. Governing Law & Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia, including but not limited to the Personal Data Protection Law (PDPL), the E-Commerce Law, and the Anti-Cyber Crime Law. Any disputes arising from or relating to these terms or the use of the Platform shall be subject to the exclusive jurisdiction of the competent courts in Riyadh, Kingdom of Saudi Arabia.

10. Changes to Terms

We reserve the right to modify these terms at any time. Continued use of the platform after changes constitutes acceptance of the new terms. We will notify users of significant changes via email or platform notification.
